Times of heightened risk to the physical safety of their citizens inevitably cause democracies to recalibrate their institutions and processes and to reinterpret existing legal norms, with greater emphasis on security, and less on individual liberty, than in "normal" times. This article explores the ways in which the American courts have responded to the tension between civil liberties and national security in times of crises. This history illustrates that courts have rejected both of the two polar positions that characterize public (...) discourse on these issues. Civil libertarians argue that political bodies are too easily gripped by passions, hysteria, and self-interest in these times and that courts therefore ought to play a central role in protecting liberty. Executive unilateralists argue that the qualities that uniquely characterize the executive branch, such as decisiveness, access to information, and efficiency, must become so dominant in these moments that few checks, if any, should constrain executive prerogatives. Oddly, civil libertarians and executive unilateralists find implicit consensus in the view that, in times of war, courts have tended not to play a significant role in overseeing executive power. We argue to the contrary: historically, a significant constitutional tradition of judicial scrutiny in the United States during times of war does exist. But this scrutiny does not take the form of courts making first-order substantive judgments about the content of liberty or other claimed constitutional rights. Nor does it take the form of judicial assessment of how significant or credible the national security claims of the executive branch might be. Instead, judicial oversight has been focused on preserving the institutional structures and processes through which decisionmaking on these issues takes place. The judicial role has centered on the second-order question of whether the right institutional processes have been used to make the decisions at issue, rather than on what the content of the underlying rights ought to be. This approach has historically rejected or resisted most claims of executive unilateralism. When courts have upheld the government's actions, they have done so only after a judgment that Congress, as well as the executive, has endorsed the action. This approach has also rejected the civil libertarian framework. When courts find bilateral institutional endorsement, they have typically accepted the joint political judgment of how liberty and security tradeoffs ought to be made. By focusing on congressional endorsement of emergency measures, the courts have created a broad-based political accountability for the actions taken in the name of national security. We suggest that even if congressional endorsement is more apparent than real in some of these contexts, the judicial maintenance of this structure of rhetorical justifications sustains desirable understandings of political structure. Because the President and Congress draw from different political constituencies in a presidential rather than a parliamentary system, we also raise questions about whether the American judicial approach to these questions should be limited to political systems with separated executive and legislative powers. It was probably written in Italy around 1550 and was first published in Portuguese in Ferrara in 1553. Although it was not widely read at the time, it was republished around the end of the sixteenth century in the Netherlands. By now it is a Portuguese classic, and a unique document in Jewish intellectual history. Usque, whose biography is almost unknown except for clues found in the Consola~am, was apparently a Portuguese New Christian (a forced convert) who fled during the persecutions of Judaizers by the Inquisition in the 1530's. He wandered in Europe and the Levant, visited Palestine, and settled down in Italy, probably in the entourage of Samuel Abravanel (the brother of Leon Ebreo), Dona Gracia Nasi (the aunt and mother-in-law of the Duke of Naxos), and Hercules of Este, the Duke of Ferrara. The book ends with a statement on just finance and the economy of life, adopted by the WCC Central Committee in September 2009. Justice Not Greed will be most useful in settings where there is interest in the intersection of ethics, the economic crisis, and Christianity in relation to the global economy, as well as among those who wish to follow the WCC. Environmental disasters like Bhopal have a way of calling attention to environmental and corporate ethical issues. This paper discusses these issues in terms of a livable environment as an inalienable right and of corporate responsibility as an philosophical and social psychological disposition that enables corporations to respect that right. The corporate conscience is compared to the individual conscience and analyzed according to the moral development theories of Lawrence Kohlberg. Its moral development is recognized as problematic from the cited performance records (...) of some leading multinational corporations and from the anti-environmental lobbying efforts of the chemical industry itself. Outreach programs in environmental health associated with research projects in corporate ethics are suggested to develop the corporate conscience for preserving environmental integrity through corporate responsibility. Neuroscientific scanning of meditators is taken as providing data on mystical experiences. However, problems concerning how the brain and consciousness are related cast doubts on whether any understanding of the content of meditative experiences is gained through the study of the brain. Whether neuroscience can study the subjective aspects of meditative experiences in general is also discussed. So too, whether current neuroscience can establish that there are “pure consciousness events” in mysticism is open to question. He had studied theology and economics in pre-Hitler Germany, and became a banker in Hamburg. In 1934 he left because of his opposition to the Nazi government and went to Italy, then England, and finally in 1936 to the United States. After World War II he (...) organized and edited the Hafner Library of Classics. In 1949 he and his wife founded the Liberal Arts Press, publishing new, inexpensive, well-edited texts of works in the humanities. This grew into the Library of Liberal Arts which was purchased by Bobbs-Merrill in 1964. Dr. Piest then went to Brussels as a representative for various American banks in connection with the European Economic Community. He retired to Switzerland in 1971, and then to Germany, where he resumed his earlier theological studies, though his health and eyesight were failing. When I visited him in 1984, I found him deeply engrossed in researching pagan religions in the Near East in early Biblical times. He also established a foundation at Mesa College in Grand Junction, Colorado and gave much of his library to them. Dr. Piest worked closely with Herbert W. Schneider, and when the possibility of founding the Journal of the Historyof Philosophyoccurred in 196o and 1961, Dr. Piest was consulted. He met with some of us, gave us his advice, and joined our Board of Directors. He also generously assisted us for several years in financing the publication of the Journal--when such assistance was vital. Thereafter, he continued to be actively interested in the Journal and other projects in the history of philosophy. Although not a professional scholar, he greatly valued work in the history of philosophy to which he made a lasting contribution through his publishing ventures, and through helping to establish theJournal. It has become popular to portray the Buddhist Nāgārjuna as an ontological nihilist, i.e., that he denies the reality of entities and does not postulate any further reality. A reading of his works does show that he rejects the self-existent reality of entities, but it also shows that he accepts a "that-ness" to phenomenal reality that survives the denial of any distinct, self-contained entities. Thus, he is not a nihilist concerning what is real in the final analysis of things. How (...) Nāgārjuna’s positions impact contemporary discussions of ontological nihilism and deflationism in Western philosophy is also discussed. (shrink)

My interest here is in the way Leo Strauss and his followers, the Straussians, have dealt with race and rights, race and slavery in the history of the United States. I want, first, to assess Leo Strauss's rather ambivalent attitude toward America and explore the various ways that his followers have in turn analyzed the Lockean underpinnings of the American “regime,” sometimes in contradistinction to Strauss's views on the topic. With that established, I turn to the account, particularly that offered (...) by Harry Jaffa, of how slavery and race comported—or did not—with the Straussian account of the political foundations of the new nation and how latter-day followers of Strauss have dealt with the persisting topic of race and racism in America. Overall, I want to make two large points. First, the Straussian commitment to superhistorical standards provides the Straussians with a moral perspective on slavery, race, and racism. Second, though race and slavery have been less than central among the concerns of most followers of Strauss, the contributions of Jaffa and others have significantly shaped the present American conservative position on race, including the idea of color-blindness. It is tempting to think that we have heard just about all we want or need to know about race. As the above quotes indicate, modern notions of race have always revolved around the faculty of vision, with supplementary contributions from other senses such as hearing, as Arendt notes in a tacit allusion to one mark of Jewish difference—the way they sounded when concentrated in urban settings. Yet two very recent works—Mark M. Smith's How Race Is Made and Anne C. (...) Rose's Psychology and Selfhood in the Segregated South —have much to teach us about how race has “worked”, particularly in the twentieth-century South but also, by implication, in the United States in general. Both works assume that, historically, race is no mere add-on to the self, a kind of externality that, once detected, can be relatively easily excised. Rather, it stands right at the heart of personal and group identity in a nation where race and ethnicity continue to assume surprising new shapes and forms. (shrink)

Few people will easily admit to taking pleasure in the misfortunes of others. But who doesn't enjoy it when an arrogant but untalented contestant is humiliated on American Idol, or when the embarrassing vice of a self-righteous politician is exposed, or even when an envied friend suffers a small setback? The truth is that joy in someone else's pain--known by the German word schadenfreude--permeates our society. In The Joy of Pain, psychologist Richard Smith, one of the world's foremost authorities (...) on envy and shame, sheds much light on a feeling we dare not admit. Smith argues that schadenfreude is a natural human emotion, one worth taking a closer look at, as it reveals much about who we are as human beings. We have a passion for justice. Sometimes, schadenfreude can feel like getting one's revenge, when the suffering person has previously harmed us. But most of us are also motivated to feel good about ourselves, Smith notes, and look for ways to maintain a positive sense of self. One common way to do this is to compare ourselves to others and find areas where we are better. Similarly, the downfall of others--especially when they have seemed superior to us--can lead to a boost in our self-esteem, a lessening of feelings of inferiority. This is often at the root of schadenfreude. As the author points out, most instances of schadenfreude are harmless, on par with the pleasures of light gossip. Yet we must also be mindful that envy can motivate, without full awareness, the engineering of the misfortune we delight in. And envy-induced aggression can take us into dark territory indeed, as Smith shows as he examines the role of envy and schadenfreude in the Nazi persecution of the Jews. Filled with engaging examples of schadenfreude, from popular reality shows to the Duke-Kentucky basketball rivalry, The Joy of Pain provides an intriguing glimpse into a hidden corner of the human psyche. Nāgārjuna’s doctrine of emptiness, his ideas on “two truths” and language, and his general method of arguing are presented clearly by him and can be stated without paradox. That the dialetheists today can restate his beliefs in paradoxical ways does not mean that Nāgārjuna argued that way; in fact, their restatements misrepresent and undercut his arguments.

Public and professional debates have come to rely heavily on a special type of reasoning: the argument-from-ignorance, in which conclusions depend on the _lack_ of compelling information. "I win my argument," says the skillful advocate, "unless you can prove that I am wrong." This extraordinary gambit has been largely ignored in modern rhetorical and philosophical studies. Yet its broad force can be demonstrated by analogy with the modern legal system, where courts have long manipulated burdens of proof with skill and (...) subtlety. This legal, philosophical, and rhetorical study by Richard H. Gaskins provides the first systematic treatment of arguments-from-ignorance across a wide range of modern discourse—from constitutional law, scientific inquiry, and moral philosophy to organizational behavior, computer operation, and personal interaction. Gaskins reviews the historic shifts in constitutional proof burdens that have shaped public debate on fundamental rights and, by analogy, on the fundamental status of intellectual and cultural authority. Using the analytic framework of normative logic presented in Fisher, Lovell, and Valero-Silva, provided here are five original business ethics mini-cases that may be used to teach and practice case analysis. We have taken the six questions that are used in the analytic framework of normative logic to solve ethical problems and have adapted them to seven steps that can be applied to conflict resolution of mini-cases in class. Then the adapted normative logic model has seven steps: Describe the “fundamental (...) needs of humankind” as they relate to the case, e.g. caring, supporting, reciprocity, fairness, trust; Explain the established norms, values, and laws that can be seen to apply in this case; State in brief the facts of the situation; Examine the network of circumstances that preceded the situation ; Generate at least three alternative positions and actions open to the actor in the case; Speculate on the hypothesized consequences of the different positions or actions the actor in the case may take; and Choose among the alternative positions the actor in the case might take and give your informed and judged reason for making that choice. A suggested answer is provided for one case, which could be reproduced as a class handout for students to examine after having done their own analysis and having discussed the case as a class. Strong, one.of the founders and leaders of the Journal of the HistoryofPhilosophy,passed away on January 13, 199o, after a long struggle with cancer. Born in Dallas, Oregon in 19~ 1, he was eighty-eight years old when he died. He did his undergraduate studies at Stanford, receiving his B.A. in 1925. Then he went on to graduate studies at Columbia, where he received a (...) master's degree in 1927 and a Ph.D. in 1937. He taught at City College in New York from 1927 to 1932, and then began his long career at the University of California, Berkeley, where he remained for the rest of his academic life. During World War II, he became laboratory manager of the university's Radiation Laboratory (now called the Lawrence Berkeley Laboratory), which was part of the Manhattan Project to develop the atomic bomb. After the war, Strong became a full professor in 1947, chairman of the Sociology Department from 1946 to 1952, Associate Dean of the College of Letters and Sciences from 1947 to 1955, a leader of the Academic Senate and its Educational Policy Committee, and Chancellor of the Berkeley campus from 1961 to 1965.This was a period of very rapid growth for the campus as well as its most troubled time. When the student rebellion--the Free Speech Movement--broke out, Strong tried valiantly but unsuccessfully to preserve those academic values he felt most challenged. As the conflict wore on, he ceased to have the full support of his superiors, the President of the Universityand the Board of Regents, who negotiated a resolution with the students, the effects of which are still being felt at Berkeley and elsewhere in the United States. Some feel that Strong's position in the struggle that transformed American universities has not been properly understood, and that his role has been portrayed unfairly to enhance that of his superiors. In any event, he resigned as Chancellor and became Professor Emeritus in 1967. Strong developed his interest in the history of philosophy, history of science, and history of ideas at Columbia during its heyday as a center for such concerns, under the leadership of John Dewey and Frederick Woodbridge. He told me that he was also very much influenced by the historical interests of Morris Raphael Cohen, his senior colleague at City College. His dissertation, Proceduresand Methods,was, and still is, a basic study of the origin and development of modern science. Philosophically he was a naturalist, continuing the Columbia tradition. He was also very interested in Bergson's views, especially as they related to modern scientific ideas. He was the inspirer and founder of the History of Science discussion group at Berkeley, which became an important forum for creative research in this area. Because of the limited attention and concern given to the history of philosophy in most of the then-existing philosophicaljournals in America, the American Philosophical Association in 1957 approved in principle the establishment of a journal devoted to the history of philosophy, and appointed a committee of six members--Paul Kristeller, Gregory Vlastos, Richard McKeon, Julius Weinberg, John Goheen, and Edward Strong--to explore "ways and means to this end." Since all American philosophical journals at that time were published in the East and Midwest, Strong and Goheen were encouraged to try to establish the journal in the West. Born in Louvain, the son of a chemistry professor at the university there, he was sent to school in England during World War I. He then returned to Belgium, and studied philosophy and theology at Louvain, and joined the Society of Jesus. He did further studies in Paris in Middle Eastern culture, and (...) studied Arabic in Syria, Lebanon, and Palestine. In Rome he did further studies and received an S.T.D. from the Pontifical Gregorian University, as well as a Licentiate in Sacred Scripture from the Pontifical Gregorian University. He was appointed professor at the Institut Catholique in Paris. He published several fundamental studies on Plotinus and the development of NeoPlatonism in Western thought. He and Hans Rudolf Schwyzer of Zurich collaborated on the critical edition of Plotinus's Enneads,and he and his former student, Pierre Hadot, produced the critical edition of the theological treatises of Marius Victorinus. Paul Henry made his first visit to the United States in 1952 where he was a visiting professor at Fordham. At a meeting of the American Philosophical Association that year he met Richard Popkin. They became close friends. This led to Henry being invited to be a visiting professor at the University of Iowa, to give the Foster lecture on the immortality of the soul at the University of California, Berkeley, and to his later being appointed a regular professor at the University of California, San Diego. He also was a visiting professor at the University of Pennsylvania, Duke, Northwestern, the College of New Rochelle and St. John's University in New York. Paul Henry was an important consultant and adviser to the JournaloftheHistoryofPhilosophy in its early years. With his vast erudition, his understanding of the different kinds of scholarship being undertaken in Europe and America, in Catholic and non-Catholic institutions, he was able to assist us in finding the best scholarly articles, the best referees and reviewers of materials in many fields. Paul Henry was a person of immense charm, vivacity and humanity. He was able to break down barriers between people of differing backgrounds, and to form deep, abiding friendships with students and scholars all over the world. He took great interest in a variety of ventures to increase learning and understanding in intellectual history. His concerns ranged from early Christian thought, pagan Neo-Platonism, the fusion of the two in Victorinus and Augustine, up to leading intellectual ideas in modern European thought such as the structuralism of LeviStrauss and the theology of Teilhard de Chardin. He encouraged young and maturing scholars in America and Europe, and tried to bring out the very best of their abilities. He encouraged the understanding of different thought systems, the appreciation of their strengths and weaknesses. And, perhaps as much as any one in the post-second-World-War period, he encouraged frank and open discussions between Catholic and non-Catholic scholars, and thereby built many bridges. Those who knew him have profited immensely from his learning, wisdom and humanity. Those who worked to launch and develop the Journal are especially grateful for his help and support in the early days of this venture.
